Fairburn was killed on Saturday 3rd June when he was run over by a tub attached to a set on which he was riding contrary to the rules. Arthur Liddle, aged 14, who was in charge of the signal arrangements, said that at the time of the accident he became so flurried when he saw the tubs off the line that he did not signal "Stop." This resulted in Fairburn being drawn under the tubs and killed before the set could be brought to a halt.
The Inspector of Mines, Mr. W. Wainwright, and the coroner, Mr. J. E. Brown-Humes, were both critical of management's decision to employ a boy of 14 to do the job. The coroner remarked:
"This child in charge of this signalling should not have been employed on such responsible work, and, frankly, I am rather appalled that a mere boy, who has just left school, should have been placed in this responsible position."
