Deceased was sitting on the limbers driving a pony drawing three full tubs outbye, on a level driving road between two landings; he was seen by another lad to fall off the limbers at a point where the road turned slightly to the left, and where a balk supporting the roof was only 5 inches above the height of the tub (4 feet 1 inch above rail level); the road inbye of this balk was for some yards back of considerable height, and further inbye was not less than 6 feet high; deceased had driven on the road for some time, but had probably forgotten for the moment the lowness of the balk, and was caught by it, there being found a bruise on his back which was the only mark of external violence; he never recovered consciousness; sudden low places on high roadways are always a source of danger
