In the second case a person engaged in removing bearing from the quarry top and taking it across a gangway to the tipping point 135 yards distant, although cognizant that shots were being fired within 50 yards of the bearing face, foolishly returned, and was struck on the head by a stone about the size of half a brick, which was projected by a gelignite shot. When he was on the tip heap he could see that shots were about to be fired, as the red flag was hoisted as a warning, but apparently he considered he was quite safe round the corner of the bearing.
