Deceased was hewing in a place 8 feet wide in the Yard band when a stone like a kettle bottom, about 2 feet diameter at the base and with a maximum thickness of 1 foot, fell from the roof close to the coal face upon him and he was dead when got clear. The colliery is a small one and the investigation into the accident revealed several breaches of the Mines Act which were the subject of a prosecution. The breaches having a bearing on the accident were failing to fix a station beyond which workmen were not to pass until the mine had been examined and failing to make such examination. It appeared that on the day of the accident water had risen on the flat sheets at the pit bottom and the miners could not get to their places until 11 a.m., and that when they were able to do so, no examination of their working places by the deputy had been made. The son of one of the owners did examine deceased's place before the accident and while deceased was working in it. A want of loose timber was not apparent. After the accident water had again risen and no inspection could be made of the place and the inquest was adjourned. Before the adjourned inquest was held another visit was made to inspect the place but the water was still up. The jury at the adjournment returned a verdict of accidental death.
