Deceased rode with the sets to within 30 yards of the shaft and occasionally assisted the onsetter there, but was not doing so on the day of the accident. The shaft is 18 fathoms deep to the seam in which deceased worked but was recently sunk other 5 fathoms to a lower seam which was being opened out by two hewers, and deceased was in the habit of leaning over a crossbar fencing the shaft at the upper seam to converse with them. There was only one cage in the shaft, and the onsetter had signalled it to the surface empty and the engineman lifted it away, but finding it was empty set it back again as there were no empty tubs on the surface. After it had gone four or five fathoms it came in contact with deceased's head as he leaned over the crossbar
