No. 3 on the list took place at Eston Mine, where Edmund Dukes was killed by a fall of stone.
The deceased and his mate Tumman started work in a new place in the broken about 6 a.m. The overman had taken them to the place the day before and showed them where they were to work, but said that they were not to start till some timber was put in. He also told one of the deputies to put some timber in before the men began. This deputy was not at work the next day, and his duties devolved upon another. This other deputy examined the place before the men went in, and he said he told them not to begin work until timber was put in ; but Tumman said he only told them not to fire a shot till the deputies came and put timber in. They worked in the place until 10 o'clock (but fired no shot), and then as the deputies had not come they went out to go home, but meeting the deputies they returned with them to the place. The deputies put some timber in, and they ordered the miners to take some bad stone down at the face, and left. Instead of taking this bad stone down at once, as they should have done, Dukes, who was the leading man, began to charge a hole, and while he was doing so the stone fell and killed him.
