No. 33 accident in the list occurred as follows :— The deceased went down the pit to the uppermost of two working seams to attend to his duties as a horseshoer, and returned to another shaft where there was no onsetter at the upper seam, and he consequently gave the signal to be drawn up, himself; but from some oversight or delay on his part, he appears not to have got into a safe position in its being drawn away, one of the point guides probably caught his foot and precipitated him to the bottom of the shaft, a depth of about 40 fathoms. The evidence went to show that he had the option of coming up the same shaft by which he had descended, where there was an onsetter to give the signals.
